“At that point, they knew with certainty that he would be testifying, and there’s a lot of reasons why (Fox) probably didn’t want him to testify, whether it’s fear that he would hurt the case, whether his health was a factor, whether they didn’t want to put him in jeopardy,” Gerry said. “They have other cases, too, and they may not have wanted him to testify because it might hurt some of the other similar cases.”
