In the article, Pat notes that a Chapter 11 bankruptcy filing may not prevent an ultimate liquidation: "[t]he whole point of Chapter 11 is to reorganize around the strongest part of the company. You have to have free cash that's not otherwise pledged to lenders, and you have to have some assets that haven't been liquidated pre-filing." Where Sears has "methodically sold off most of its valuable parts [since 2010] in an effort to stay afloat," it is unclear whether reorganization would be possible.
