Sullivan & Worcester was the host and sponsor of ACC Northeast's program, "Successful Commercial Lease Negotiation & Navigating Everyday Tenant/Landlord Issues," which was held on March 5, 2018. Sharon Leifer moderated and Warren Heilbronner spoke at the program.
The program featured national property managers, in-house counsel, real estate brokers and law firm real estate lawyers discussing what is needed to successfully negotiate a lease from a tenant or landlord perspective. It highlighted several aspects of office and retail leases that are most often the source of dispute in negotiating and administering these leases, including:
- Economic matters, including landlord concessions, rent abatement, percentage rent, expense pass-throughs and audit rights
- Landlord relocation and consent rights, including estoppels and SNDAs
- Tenant inducements, including termination, expansion and contraction options and rights of first offer/refusal
- Co-tenancy, "going dark" and exclusivity provisions in the context of retail leases
