TTAB Refuses 'Swiss Grills' Mark For Lack Of Intent

September 14, 2015

Gerald D. Silver was quoted and Kimberly B. Herman was mentioned in an article, "TTAB Refuses 'Swiss Grills' Mark For Lack Of Intent," published by Law360 on September 14, 2015.

The article summarizes Sullivan & Worcester's win for its UK client, Swiss Grills Group Ltd., a manufacturer of Swiss Grill barbecues, before the Trademark Board. Wolf Steel, a manufacturer of Napoleon barbecues, filed an application to trademark SWISS GRILLS. S&W opposed the filing, arguing that Wolf Steel lacked a bona fide intent to use the name in connection with barbecues and outdoor grills. The Board agreed that Wolf Steel lacked credibility and sustained the opposition. Also, the Board found that Swiss Grill proved priority of use in the U.S., which clears the way for Swiss Grill to obtain the SWISS GRILL trademark in the U.S.
